SwPt is a unique and exclusive website dedicated to the Swinger lifestyle, allowing you to build your profile and manage your network of contacts through powerful virtual tools, messaging systems and the sharing of photographic and audiovisual content. The site is designed to promote communication, host notifications of Swing Events, gatherings, parties and private encounters or through Swing Clubs, the sharing of information, and introductions between people who share the same network and interests, and as such promotes the ideology, lifestyle and appreciation of Swinging. This platform is for adults only (it contains nudity and sexually explicit content).

The disclosure of personal information is always a sensitive matter, and SwPt takes it extremely seriously. We consider the protection of our members' privacy our highest priority. To that end, this Privacy Policy outlines the types of information SwPt collects and how that information is used to operate our site. All information collected by SwPt must comply with this privacy policy and will be used for the sole purpose of providing you with a highly personalized and interactive experience on our site. No personal information collected about our members will ever be sold or disclosed to third parties without appropriate consent.

About the information collected and how it is used.

1. Registration

To create your account as a registered member of SwPt, you must choose a Profile/Account Type such as Single or Couple, a Nickname, a Password and an email address. You will also need to fill in the required registration fields — which are clearly marked — for all people on the profile, as well as complete a security code (when and if applicable) and read and agree to our Terms of Use and this Privacy Policy.

Additionally, you may be asked to provide certain personal information such as: Personal Description, Postal Code, Skype contact, Height and Weight, Eye and Hair Color, Marital Status, Sexual Preferences / Bisexuality, information about whether you smoke, drink, have tattoos or piercings, and to upload a photograph to be used as your Avatar/Profile Picture. Additional profile information may also be added whenever you participate in a SwPt Event.

Your Nickname is used to give you a unique account ID with which you can access SwPt. As such, your Nickname and Avatar/Profile Picture will be visible to anyone who visits the public-facing pages of SwPt.

Your email address is used to identify you within our system, to contact you about your activities on the site (including, but not limited to, registration confirmation / welcome emails, important news affecting your relationship with SwPt, marketing or promotional emails from our Marketing department, and to gather responses to surveys or questions that help us improve our site according to your needs and suggestions), and to forward messages sent to you by other SwPt members.

Your Personal Description, Postal Code, Height and Weight, Eye and Hair Color, Marital Status, Sexual Preferences / Bisexuality, and information about whether you smoke, drink, have tattoos or piercings may be visible to other active SwPt members. You control whether other active registered SwPt members can or cannot see your email contact (Skype contact) on your personal profile page, and you can further limit access to your account or to parts of your account by using the privacy settings available according to your account type. Please note that even when you restrict who can see your profile and the personal information on your profile page, it may in some cases still be made available to people in your network (for example, your friends), and members of any private group you belong to may be able to see that information, and members who already know you may still find you through searches by email address, Nickname or location. SwPt will never share your personal information with any non-registered user of our site, or with any third party or other person, without your explicit consent.

Finally, note that after registration, SwPt will send you a registration confirmation / welcome email, possibly with instructions on how to finalize your registration and activate your account so that you can access the site's content (where applicable, and depending on the account and profile type).

2. Groups

Another important feature of SwPt is the ability to create groups based on shared interests and to invite contacts who share those interests to join your group. If you create a group, you will be required to provide a minimum of information to identify the group — without which the group cannot be created — such as the group's name, a unique abbreviation, a photograph for an avatar/profile picture, and a short description of the group. All groups created must be approved by SwPt Administration, whose decision criteria for approval follow the SwPt Terms of Use.

3. The “My Profile” Page

Your profile page will include information about you that enables other SwPt members to find you in searches and invite you to their friends list, events, groups or chats. Information on your profile can be seen by all active SwPt members. If you choose to upload an Avatar/Profile Picture, it may also be visible to all SwPt members. You choose what other optional additional information appears on your profile page, although the Nickname and Avatar/Profile Picture are always visible to your direct contacts and even to non-members who visit public-facing pages. However, both your profile description and your photo albums, as well as the URL for accessing the menu of all photos, are not publicly accessible.

Profile information may include the following: personal description, Postal Code, Skype contact, email addresses, personal interests, and anything else you choose to share. Through your profile page you control the information that is visible on your profile and, as a result, determine who can find you in searches based on specific profile information (although anyone who knows your Nickname or email may still search for and find those, even if you have restricted access to the profile, while still being unable to view your profile itself). Providing some profile information is optional; however, it allows SwPt members to better identify with one another and to connect and interact with their network more effectively. We may use demographic information to tailor the Site to your interests.

4. Cookies and Log Files

Like most websites, SwPt uses cookies and log files to monitor site usage. A cookie is a small data file that resides on your computer and allows SwPt to recognize you as a member when you return to our site using the same computer and browser. Unfortunately, if your browser settings do not allow cookies, you will not be able to use our site properly. Cookies also help us understand how members use SwPt, which allows us to continuously improve the service. Like the information you provide at registration or on your Profile, cookie and log file data is used to personalize your experience on our site.

If you click the “remember me on this computer” option when you log in to your SwPt account, a cookie known as a “permanent” cookie will be installed. The next time you visit the SwPt site, the permanent cookie will allow us to recognize you as an existing member, so that you do not need to log in again before using the service. However, in order to change your email address or password, you will need to re-enter your password even if your computer has the permanent cookie. Additionally, if you log out of SwPt, you will need to re-enter your password the next time you visit us in order to sign in to your account. Another type of cookie, called a “temporary” cookie, is used to identify a specific visit to the SwPt site. “Temporary” cookies expire after a short period of time or when you close your browser.

When you visit the SwPt site, and due to Internet communication protocols, we automatically receive the URL of the site you came from and the URL of the site you are going to when you leave SwPt. We also receive the Internet Protocol (IP) address of your computer (or the proxy server you use to access the Internet), your computer's operating system and the type of browser you are using, as well as the name of your ISP (Internet Service Provider). Tracking technologies are used to collect statistical data about user conversions, including sales and registrations. This information may be used to analyze general trends to help us improve SwPt services, but it is not in any way associated with personally identifiable information.

5. Minors — Person(s) under 18 years of age!

In compliance with the Children's Online Privacy Protection Act, we will not knowingly give access to SwPt to people under 18 years of age. If it later comes to SwPt's attention that a member is under 18 years of age, we will take appropriate measures to remove the member's information from the database and prevent the individual from accessing the SwPt service in the future. Since all members are activated by photograph or account upgrade, in case of doubt about the age or profile of the user, SwPt reserves the right to restrict access to SwPt and to request personal information such as an official document or proof of date of birth.

With whom the information may be shared

1. Third Parties

SwPt will not sell or transfer your personal information to third parties without your explicit consent, except when required for legal reasons. We may share your information with third parties under certain circumstances:

• if it is necessary to share your information to carry out a specific request of yours (for example, the purchase of account upgrades by credit card, in which case it would be necessary to share your information with the credit card processing company). In these specific cases, no personally identifiable information will be retained, shared or kept by third parties except to provide the specific services requested by you, and they are bound by strict confidentiality agreements that limit their use of such information;
• if we are asked to share your information for legal reasons, or if it is necessary to respond to a subpoena, judicial warrant or court order, or to protect the rights of SwPt and its members;
• if you give us explicit permission to share your information for any reason not set out in this Privacy Policy.

2. Other SwPt Members or Non-Members (inactive members)

Occasionally, you may invite a non-member of SwPt to register on the site and join your network or group. You may also invite SwPt members to join a group or become your friends. In these cases, SwPt generates an email message to your guest that may contain information such as your Nickname and your Avatar/Profile Picture (if you have one set). The rest of your contact information, as well as the level of visible information (beyond the required registration fields), will only be shared with the members you have authorized in Profile Settings, Profile Privacy Settings and Account Privacy to see your profile and personal information. Additionally, when you visit another SwPt member's profile, we may share with that member your Nickname and Avatar/Profile Picture (if you have one set), along with the date and time you visited the profile. Furthermore: My Friends, Personal Endorsements, Profile Comments, Blog Comments, Event Participation, Chat Rooms, Interest Groups, Raffles and Prizes Lists, and internal and external search engines may contain your Nickname and Avatar/Profile Picture.

3. Promoters and Advertising

We may use external promotion and advertising organizations such as Swing Clubs or Private Party Organizers to promote and advertise products or services on our site. These organizations may use cookies and tags to measure the effectiveness of their advertising. Any information that third parties collect through cookies and tags will be completely anonymous.

Additionally, SwPt may use its Marketing team and the tools available on the site to advertise and promote, in whatever way they deem appropriate, any products or services — whether from SwPt, its associates, or third parties — using the site's internal mail or the email addresses members provide in their profile information. However, this action is carried out internally and no personal information will ever be sold, provided or transferred to third parties without appropriate consent.

4. Links to Other Sites or Swing Club Pages

You may occasionally see links to other websites on SwPt, whether through advertising or other types of third-party promotions or links placed by other SwPt members. SwPt is not responsible for the privacy practices of other sites you visit through a link found on SwPt. If you provide information directly to third parties other than SwPt, the third party's use of your information may be covered by different Privacy Policies. Please always read the Privacy Policy of any company before providing your personal information.

Security

SwPt has implemented security measures to protect against the loss, misuse or alteration of member information. We use industry-standard measures such as encrypted data storage, firewalls and password-protected systems to safeguard the confidentiality of your personal information. All of our staff are aware of our security policies, and your information is only available to staff members who need it to do their job.

You have control over your Personal Information

The success of SwPt is directly related to your trust in our privacy measures. While we encourage our members to share information to get the most out of the site, we also let you control how certain personal information is made available on the site. While we provide powerful tools for you to share information, remember that it is always your choice whether or not to share certain information with other SwPt members or the general public.

You may change any personal information stored on the SwPt site at any time, whether it is information provided at registration (with the exception of your user number or ID), for your profile page, or for any other purpose. You can change the information in your profile area. Additionally, you may suspend or cancel your SwPt account at any time through the menus available on the site for that purpose, or by requesting it directly by email through our contact addresses (in which case the time taken to process your request will depend on the availability of our staff).

Once your request to delete the account is processed, and in accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data: all your content will be deleted, and this process is not reversible.
